Terms of service

Draft — needs legal review before launch.

These terms are an agreement between you and Tappius Mobile LLC (“we”, “us”), and they cover your use of Cue: the After Effects panel, its helper software, our website and our online services (together, the “Service”). By creating an account or using the Service, you agree to them. If you use the Service for a company, you confirm you’re allowed to accept these terms for it.

1. What the Service is

Cue is a panel for Adobe After Effects that uses artificial intelligence to make changes in your open project when you ask it to: creating layers, keyframes, effects, expressions, text, shapes and masks, and analyzing tutorial videos you provide. Cue is not made, endorsed or sponsored by Adobe. After Effects is a trademark of Adobe Inc.

2. Your account

  • You need an account to use the Service. Keep your sign-in method (your email or Google account) secure; you’re responsible for activity on your account.
  • You must be at least 16 years old, or the age of digital consent where you live if that’s higher.
  • Give us an email address that works. We use it for sign-in codes and important account and billing messages.
  • One person per account. Don’t share accounts or resell access.

3. Credits, plans and payment

  • The Service is paid for with credits. Each request uses credits according to how much AI processing it needs. The panel shows your balance, and our credits guide explains typical costs.
  • Trial credits. New accounts get free trial credits. They have no cash value, can’t be transferred, and may expire or be withdrawn if they’re abused (for example, by creating several accounts).
  • Plans. A plan is a subscription that grants a set number of credits each billing period. It renews automatically until you cancel. Unused plan credits expire at the end of each billing period.
  • Top-ups. A top-up is a one-off purchase of credits. Top-up credits expire 12 months after purchase.
  • Credits are not money, can’t be exchanged for cash, and are not refundable except as set out in our refund policy.
  • Merchant of record. Our orders are processed by Polar Software Inc. (“Polar”), which acts as merchant of record. Polar is the seller of record for your purchase and handles payment processing, applicable sales tax and VAT, receipts and invoices. Polar’s own terms apply to the payment. We never see or store your full card details.
  • Price changes. We may change prices or plan contents. Changes to a subscription take effect at your next renewal, and we’ll tell you in advance by email.
  • Cancelling. You can cancel at any time from the billing portal (Account ▸ Manage billing). Your plan stays active until the end of the period you’ve paid for, then stops renewing.

4. Acceptable use

You agree not to:

  • use the Service to create content that is illegal, infringes someone else’s rights, or harasses, defames or sexually exploits anyone;
  • analyze videos you don’t have the right to use for this purpose (see section 6);
  • try to get around credit metering, usage limits or security, or access other users’ data;
  • reverse engineer, scrape or overload the Service, or use it to build a competing service;
  • use automated means to create accounts or send requests outside the panel;
  • resell or sublicense the Service without our written permission.

We may suspend or close accounts that break these rules. Where reasonable, we’ll tell you first and give you a chance to fix the problem.

5. AI-generated output

  • The Service uses AI models, which can make mistakes. Results may be inaccurate, incomplete, or different from what you asked for. Review everything it does before you rely on it or deliver it to a client.
  • Each change is recorded as a normal step in After Effects‘s undo history, and the Service may save a restore point (a copy of a comp inside your project) before large changes. But it acts in your real project, so keep your own backups, as you would with any tool.
  • Ownership. As between you and us, you own the changes the Service makes in your projects and the content you provide, to the extent the law allows. We don’t claim ownership of your projects. Similar requests from other users may produce similar results, and AI output may not be protected by copyright in some countries.
  • You are responsible for how you use the output, including making sure it doesn’t infringe anyone else’s rights.

6. Tutorial videos and other content you provide

  • When you give the Service a video link or file, you confirm that you have the right to have it analyzed for this purpose, for example because it’s publicly available for viewing and you’re using it to learn a technique, or because you own it.
  • Downloads of videos from TikTok, Instagram or local files happen on your own computer, at your request. YouTube links are passed to our AI provider for analysis.
  • You give us permission to process the content you provide (prompts, project information, frames, videos and links) only to run the Service for you, as described in our privacy policy.
  • We don’t use your projects, frames or videos to train AI models.

7. Third-party services

The Service relies on third parties, including Google (Gemini AI models), Cloudflare (hosting and infrastructure), and Polar (payments). Their availability affects ours, and their terms may apply to parts of your use. We’re not responsible for third-party websites or video platforms you link to.

8. Software license

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Cue panel and helper software on computers you control, for as long as you have an account and follow these terms. The software includes open-source components, which are licensed under their own terms. Those notices ship with the software.

9. Changes to the Service and these terms

We’re improving the Service all the time and may add, change or remove features. If we make a material change to these terms, we’ll email you or notify you in the panel at least 14 days before it takes effect. If you keep using the Service after that, the new terms apply. If you don’t agree, you can cancel and stop using it.

10. Ending your account

You can stop using the Service and ask us to delete your account at any time by emailing support@cue.example. We may suspend or end your access if you seriously or repeatedly break these terms, if required by law, or if we discontinue the Service. If we discontinue the Service, we’ll give you reasonable notice and a pro-rated refund for any prepaid, unused subscription period.

11. Disclaimers

The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise the Service will be uninterrupted or error-free, or that AI output will be accurate or suitable for your purpose.

12. Limitation of liability

To the extent the law allows, neither we nor our suppliers are liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or project files. Our total liability for any claim related to the Service is limited to the amount you paid for the Service in the 12 months before the claim, or USD 50, whichever is greater.

Nothing in these terms limits liability that can’t be limited by law, or your rights as a consumer under mandatory law where you live.

13. Governing law and disputes

These terms are governed by the laws of TODO Country, without regard to its conflict-of-law rules. Courts in TODO Country have jurisdiction, except where consumer protection law gives you the right to bring proceedings where you live. Before going to court, please email support@cue.example so we can try to resolve the problem informally.
